Welcome to Dynovex Tech ("Dynovex," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of www.dynovextech.com (the "Website") and all web design, website development, logo design, branding, animation, SEO, social media marketing, app development and related digital services (the "Services") that we provide.
By visiting the Website, contacting us, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Website or our Services.

2. Eligibility
You must be at least 18 years old and have legal authority to enter into a contract. If you are ordering on behalf of a company or organization, you confirm that you are authorized to bind that business to these Terms.
3. Our Services and Packages
3.1 Packages. The Website lists service packages (for example Website, E-Commerce, Logo, Branding, Video Animation, Social Media, SEO and Combo packages). Each package includes only the features listed in the package description or in your written order confirmation.
3.2 Custom work. Features, pages, integrations or deliverables that are not listed in your package are out of scope. We will provide a written quote for additional work before starting it.
3.3 Pricing. Prices are shown in US dollars and may change at any time. Promotional or discounted prices apply only for the period stated. The price confirmed in your invoice or order confirmation is the price you will pay. Third-party costs (for example premium plugins, paid stock media beyond what is included, hosting, domain renewals, payment-gateway fees and advertising spend) are not included unless stated.
3.4 Service descriptions. We make reasonable efforts to keep the Website accurate. Descriptions, images and portfolio samples are for illustration and may differ slightly from final deliverables.
4. Ordering and Project Process
4.1 Order acceptance. An order is accepted when we confirm it in writing (including by email) and receive the required payment.
4.2 Our process. Projects generally follow four stages: (1) sharing your vision and requirements, (2) strategy and creative planning, (3) design, development and refinement, and (4) delivery and support.
4.3 Client responsibilities. You agree to provide accurate information, content, logos, images, login details and timely feedback and approvals. Delays in providing these items may delay delivery. We are not responsible for delays caused by late or incomplete client input.
4.4 Timelines. Delivery dates are estimates unless agreed in writing. We aim for timely delivery but do not guarantee exact dates.
5. Payments
5.1 Payment terms. Unless your invoice states otherwise, payment is due as set out in your order confirmation, and work may begin only after the initial payment is received.
5.2 Accepted methods. We accept the payment methods shown at checkout or on your invoice. Payments are processed by third-party payment providers. We do not store your full card details.
5.3 Late payment. We may pause work, withhold final files or delay launch until overdue amounts are paid. We may charge reasonable late fees where permitted by law.
5.4 Taxes. You are responsible for any applicable taxes, duties or levies, unless included in the price.
6. Revisions
Our packages advertise unlimited revisions. This means unlimited reasonable revisions to the agreed scope during the active design and development of the project. Revisions do not include new pages, new features, a complete redesign after approval, or a change of direction from the approved concept. We may treat such requests as new work and quote them separately. Projects that remain inactive for an extended period because of missing client feedback may be treated as completed.
7. Satisfaction Guarantee and Refund Policy
7.1 Satisfaction guarantee. We work to ensure you are satisfied with the final result and will keep refining the project within the agreed scope until it meets the approved requirements.
7.2 Money-back guarantee. Where your package includes a money-back guarantee, you may request a refund by emailing info@dynovextech.com. Refund eligibility, the request window and any deductions are determined as set out in your order confirmation. Unless your order confirmation states otherwise:
- refunds may be reduced by work already completed and by non-recoverable third-party costs (such as domain registration, paid licenses or ad spend);
- refunds are not available once the final deliverables have been approved, accepted, launched or the final source files have been delivered;
- refunds are not available where delays or non-delivery are caused by the client, or where the client requests a change that conflicts with the originally agreed requirements.
7.3 Approved refunds are returned to the original payment method within a reasonable time after approval.
7.4 This section does not limit any rights you have under applicable consumer law.
8. Ownership and Intellectual Property
8.1 Client ownership. Subject to full payment, you receive ownership of the final, approved custom deliverables created specifically for you (such as your final logo, custom website design and source files, where included in your package). We refer to this on our Website as "100% Ownership Rights."
8.2 Excluded materials. Ownership does not extend to third-party materials, including stock images, fonts, plugins, themes, frameworks, open-source code, software libraries and templates. These remain subject to their own license terms.
8.3 Our retained rights. We keep ownership of our pre-existing tools, code libraries, methods, know-how and unused concepts, and any work not selected or paid for.
8.4 Portfolio use. Unless you notify us in writing before the project starts, you agree that we may display the completed work and describe our involvement in our portfolio, website and marketing materials.
8.5 Your content. You confirm that you own, or have the right to use, all content you give us (text, images, logos, trademarks, data) and that it does not infringe any third party's rights. You grant us a limited license to use it solely to perform the Services. You agree to indemnify us against claims arising from content you supply.
9. Design Originality
We aim to deliver original work. However, we cannot guarantee that a logo, name or design will not resemble an existing mark or be registrable as a trademark. You are responsible for conducting trademark searches or legal clearance before using any brand asset commercially.
10. Third-Party Services
Our Services may rely on or integrate third-party tools, such as payment gateways, WordPress and plugins, hosting providers, domain registrars, analytics, social media platforms and advertising networks. We are not responsible for their availability, performance, pricing, policy changes or security. Your use of them is governed by their own terms.
11. SEO and Marketing Services
SEO, social media and digital marketing results depend on factors outside our control, including search engine algorithms, competition, platform policies and market conditions. We do not guarantee any specific ranking, traffic, lead volume, engagement or sales result. Descriptions such as "improved visibility" describe our objectives and methods and are not guarantees.
12. Hosting, Domains, Maintenance and Support
Unless expressly included in your package, hosting, domain renewals, ongoing maintenance, security monitoring, content updates and technical support after delivery are not included. Where a package includes a free domain for a stated period, renewal after that period is your responsibility. Our "no monthly fees or hidden charges" statement refers to the fees for the package itself and does not cover optional or third-party services you choose separately.
13. Testimonials and Marketing Claims
Testimonials on the Website reflect individual experiences. Results vary depending on each client's business, industry and input. Experience with our Services may differ.
14. Acceptable Use of the Website
You agree not to:
- use the Website for any unlawful, fraudulent or harmful purpose;
- attempt to gain unauthorized access to the Website, servers or data;
- upload viruses, malware or harmful code;
- scrape, copy or reproduce our content, designs or portfolio without permission;
- interfere with the Website's operation or security;
- impersonate any person or misrepresent your affiliation.
We may suspend or block access to the Website if we believe these Terms are being violated.
15. Website Content and Intellectual Property
All content on this Website, including text, graphics, logos, videos, animations, layout and code, is owned by or licensed to Dynovex Tech and protected by copyright, trademark and other laws. You may view and print pages for personal, non-commercial use. Any other use requires our written permission.
16. Confidentiality
Each party agrees to keep confidential any non-public business information received from the other and to use it only for the project, except where disclosure is required by law.
17. Disclaimer of Warranties
The Website and Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Website will be uninterrupted, error-free or free from harmful components.
18. Limitation of Liability
To the fullest extent permitted by law, Dynovex Tech and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue, lost data or business interruption. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the specific Services giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
19. Indemnification
You agree to defend and hold harmless Dynovex Tech and its team from claims, damages, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of the deliverables.
20. Termination
You may cancel a project by written notice. Amounts due for work already completed remain payable, subject to Section 7. We may suspend or end Services if you breach these Terms, fail to pay, or fail to cooperate for an extended period. Sections that by their nature should survive termination (including ownership, payment, liability, indemnification and governing law) will continue to apply.
21. Force Majeure
We are not liable for delays or failure caused by events beyond our reasonable control, including natural disasters, outages, internet or hosting failures, strikes, government actions or pandemics.
22. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law rules. Before starting any formal proceedings, both parties agree to try to resolve disputes in good faith by contacting info@dynovextech.com. Any unresolved dispute will be brought in the state or federal courts located in Illinois, and you consent to their jurisdiction.
23. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last Updated" date. Continued use of the Website or Services after changes means you accept the revised Terms. Orders already confirmed remain subject to the Terms in effect when they were placed, unless both parties agree otherwise.
24. General Provisions
- Entire agreement: These Terms, together with your order confirmation and our Privacy Policy, form the entire agreement between you and Dynovex Tech.
- Severability: If any provision is found unenforceable, the rest remains in effect.
- No waiver: Failure to enforce a right is not a waiver of that right.
- Assignment: You may not transfer your rights under these Terms without our written consent.
- Notices: We may send notices by email or by posting on the Website.
